1 TITLE
1.1 The Club shall be called Dubai Marina Yacht Club, hereafter to be referred to as “the Club” and shall be affiliated to the UAE Sailing Federation, Australian Marine Association, International Marine Institute and British Marine Federation.

2 OBJECTS
2.1 To foster and promote the sport of leisure boating at all levels, providing opportunities for recreational and competitive yachting.
2.2 To offer members exclusive rights to yacht berthing within the Dubai Marina canal.
2.3 To offer a relaxed clubhouse environment with the provision of dining and entertainment
2.4 To create and promote teams to participate in national and international sporting events to represent both the Club and UAE.

3 MEMBERSHIP
3.1 Membership of the Club is offered exclusively at the discretion of the General Manager and his officers and is available to those with proven yacht ownership or an interest therein.
3.2 There shall be three classes of membership available. These are:
3.2.1 Individual;
3.2.2 Corporate;
3.2.3 Commercial
3.3 Applications for Membership shall be made in the prescribed form, must be signed by the Applicant and will not be confirmed without presentation of joining fee, crossed for the publicised amount.
3.4 Memberships are valid for one (1) year from date of approval and are not transferable or assignable, except for elements of Corporate Membership, at the discretion of the General Manager.
3.5 Fees and assessments are determined by the Club’s Administration Department and are subject to change without notice. All membership fees and other charges/dues must be paid in advance at the start of the membership term. Joining fees for new members are non-refundable.
3.6 Individual memberships permit the nominated member to entertain their family and friends, providing they are present in the Club and have registered their guest names with reception.
3.7 Corporate membership permits up to eight (8) nominated individuals from the corporation stated. Any transfers should mandate a revision of the membership agreement duly signed by the authorized signatories of the company and subject to the Club’s approval and transfer fees.
3.8 Commercial memberships apply to commercial clients using their berths for commercial purposes, e.g. charter or sales.
3.9 The lease of berths is reserved for valid DMYC members and, on a temporary basis, visitors authorised by the Club only.
3.10 The Club may at any time and in its absolute discretion invite any person(s) to be an Honorary Member upon such terms and conditions and for such periods as the Club may determine.
3.11 An Honorary Member shall have such rights and privileges as the Club may from time to time in its absolute discretion determine.
3.12 A new Member shall not participate in any of the advantages and privileges of the Club until they have paid the publicised Joining Fee, Annual Fees and any other stipulated amounts.
3.12 Members shall not be liable in any way for the debts owing by the Club.

4 MANAGEMENT & OFFICERS
4.1 The affairs of the Club shall be controlled by the General Manager and the Club Officers that constitute his Steering Committee.
4.2 The Officers of the Club are full-time employees and shall consist of:
4.2.1 General Manager
4.2.2 Harbourmaster
4.2.3 Marina Administration Manager
4.2.4 Food and Beverage Manager
4.2.5 Sales and Marketing Manager
4.3 The duties of the Club Management shall be:
4.3.1 To control the affairs of the Club to the benefit of the Members
4.3.2 To keep accurate and accountable finances of the Club.
4.3.3 To provide sufficient staffing to ensure a safe and secure environment within the Club and its grounds
4.3.4 To provide safety, security and DMYC Member support in all the Club’s yacht berthing facilities, and at all times of day.

5 CLUBHOUSE RULES
5.1 Non-DMYC members may only gain entry as a guest of a current DMYC member or for express use of the Club’s dining facilities
5.2 The Club’s facilities are for the private, non-commercial use of its members, except as authorized by the General Manager or his Officers.
5.3 Children under 12 years of age shall not be left at the Club’s premises without adult supervision by parent or qualified guardian.
5.4 No pets shall be allowed within the Club’s premises
5.5 No food or drink purchased or prepared off premises shall be consumed by members or guests within the club premises.
5.6 Smoking is only permitted in designated areas. Patrons under 21 years of age shall not be permitted in smoking areas.
5.7 All DMYC members must register their arrival at the Club and all guests must be signed in at reception
5.8 Specific areas of the Club’s facilities are available for DMYC members to hire for functions and meetings. All arrangement of such events must be handled directly by the Events and Marketing department. No outside catering or alcohol sponsorship is allowed for such events, and all consumables must be organised through the Club’s catering department.
5.9 Any event must follow Dubai Municipality, UAE and Club rules regarding behaviour, noise and numbers. All events must have a dedicated organiser who is held liable and responsible for the invitees during the period of the function.

6 FEES, SUBSCRIPTIONS AND OTHER PAYMENTS
6.1 The Club shall have the power at any time to introduce, fix, suspend or vary the rates and amount of Joining Fee, Annual Fee, Transfer Fee, Registration Fee, Guest Fee or any other fees, charges payable by any class of Members or in respect of any member of the family of a member of the Club.
6.2 Members admitted during the year shall pay a pro rata fee based on the annual membership cost divided by the number of months before December 31st.
6.3 The Joining Fee payable by the various categories of Members shall be determined by the Club and is a non-refundable sum due before membership may commence.
6.4 The Annual Fee is a recurring sum on yearly renewal of Membership and shall be determined by the Club from time to time.
6.5 For renewal of Annual Membership, the Annual Fee shall be due in advance on 30th December for the preceding year in respect of which the same are payable.
6.6 Members who do not respond to repeated calls for membership renewal payment following a period of 31 days overdue may be sanctioned under Rule 12.

7 RESTRICTION OF PRIVILEGES
7.1 The Club may in its absolute discretion restrict the privileges of any Member in respect of any facility if it appears to the Management that such facility of the Club is over congested.
7.2 The Management may at any time withdraw the privilege of the Club from any guest.
7.3 No person who has ceased to be a Member under Rule 12 or from whom the privileges of the Club have been withdrawn may be introduced as a guest into the Club.
7.4 The Club may in its absolute discretion at any time allow any of the facilities to be used for private functions, meetings, conferences or any other purpose whatsoever, by any Member or any other person subject to such conditions as the Club may prescribe, and during such events the Club may withdraw such facilities for the use of the Members.

8 PROHIBITIONS
8.1 Illegal activity of any kind is strictly forbidden on the Club premises.
8.2 No Member shall borrow monies or incur any obligation or liability in the name of, or pledge the credit of the Club.
8.3 No Member shall, without the prior written approval of the Club, use the address of the Club in any advertisements or use the Club’s address or Premises for any commercial purposes.

9 INTERPRETATION OF RULES
9.1 The Club is the sole authority for the interpretation of these Rules and of the Bye-laws made here-under, and the decision of the Management thereon shall be final and binding on all Members of any class.
9.2 The Club shall have power to make, rescind or alter Bye-Laws as it may consider necessary.
9.3 The Club may from time to time revoke, alter or add to any of the Rules. Subject to these Rules, the Club shall have the full powers to decide all questions relating to the management of the Club and all questions relating to such management, arising out of or not covered by any Rules.

10 DONATIONS
10.1 The Club shall have power to grant donations to charitable organizations.

11 RESTRICTION OF MEMBERSHIP
11.1 The Club shall have power at any time to restrict the number of Members and from time to time vary or rescind such restriction, and for this purpose may order that all applications for membership be held in abeyance.

12 CESSATION OF MEMBERSHIP
12.1 Any Member shall have their membership and privileges terminated and any held balance non-refundable on occasion that:-
12.1.1 Who has been convicted of any offence involving violence or dishonesty or shall suffer imprisonment for any reason whatsoever;
12.1.2 Who leaves the country to escape criminal proceedings;
12.1.3 Who makes a composition or arrangement with his creditors;
12.1.4 Who has been adjudicated bankrupt as from the date of such adjudication;
12.1.5 Who being a Corporate Member is wound up by a Court Order or effective resolution;
12.1.6 Who has been expelled under Rule 13 or who resigns by notice in writing;
12.1.7 Who has refused, through notice or inaction, to renew annual fees.
12.2 A Member who ceases to be a Member under this Rule or under Rule ** for non-payment of accounts shall, subject to paragraph 12.1 of this Rule, forfeit all rights to the Club, its property and its funds but shall not be released of his liability to the Club and shall not thereafter be eligible as a candidate for membership of the Club.
12.3 Any Member may resign his membership by giving 30 days notice to the General Manager of such resignation, but such Member shall be liable for the outstanding balance in the Member’s Account and any other monies due from the Member to the Club.
12.4 The Club shall refund up to six (6) months of Annual Fees, providing the resignation notice was received within the first half of the annual contract period.

13 EXPULSION & SUSPENSION OF MEMBERS
13.1 If in the opinion of the Club, any Member acts in any way prejudicial to the interests of the Club or its Members, or shall break any Rule, Bye-Law of the Club, the Management shall consider whether there is sufficient evidence to justify calling the Member to answer any charge made against him. In such case, a notice in writing shall be given to such Member calling on him to attend a meeting for the purpose of answering such charges. Such notice shall not be less than seven days.
13.2 At such meeting, the Member concerned shall be informed of the charges made against him and shall have the right to be heard in his own defense. If after hearing such Member the Management decides to expel the said Member, he shall thereupon cease to be a Member of the Club and shall forfeit all his rights and privileges. The Management may at the conclusion of such hearing suspend the Member or impose any lesser penalty. Notice thereof shall thereafter be sent to such Member. If such Member refuses to attend the meeting in answer to the notice calling upon him to do so, the Management may nevertheless proceed in his absence.
13.3 No appeal shall lie from the decision of the Management to any other meeting or to a Court of Law.
13.4 Persons who have had their membership terminated shall not be permitted to berth boats at the marina for a period not less than 2 years from the date of termination.
13.5 A Member who ceases to be a Member under this Rule shall not thereafter be eligible as a candidate for membership of the Club, and may be refused entry to the premises on these grounds.

14 MEMBER CONTACT DETAILS
14.1 All Members shall keep the Club informed of changes in their contact correspondence address, phone number and email address.
14.2 Any notice posted to the last address given to the Club by any Member shall be deemed to have been given to such Member.

15 EXEMPTION
15.1 The Club and any person appointed or employed by the Club shall not in any manner be liable:-
15.1.1. For any claims, demands or damages howsoever suffered by a Member or its Nominee, any of their guests, invitees, spouse or children or any other person at the Premises as a result of any loss or damage to any property or article whatsoever, or howsoever brought upon or left at the Premises by such a person.
15.1.2. For any injury, loss of life, or other loss whatsoever, or howsoever caused to a Member, a Nominee, any of their guests, invitees, spouse or children or any other person at the Premises or vis-à-vis the use and enjoyment of the Facilities.
